1 General

The Touch for Health to go app is provided and operated by Code & Harmony LLC, 30 N Gould St Ste R, Sheridan, WY 82801, USA, represented by Conny Bruhn (Managing Member), hereinafter referred to as: Code & Harmony LLC / we.

The protection of personal user data is very important to us. We conduct our activities in accordance with the applicable legislation on the protection of personal data and data security. These Terms of Use inform users about the scope of the application, liability issues and responsibilities.

Use of TFH to go and its content requires prior express consent to these Terms of Use and the Privacy Policy. Applying the kinesiological method Touch for Health requires basic knowledge, which was acquired as part of a course, training or by reading relevant literature.

The app is based on the original work Touch for Health Complete Edition 2005, John and Matthew Thie, under license from the copyright holders.

Touch for Health to go is a smartphone application (app) that supports trained kinesiologists and people interested in kinesiology in using the Touch for Health technique to help themselves or others to release blockages and find balance.

None of the services offered by Code & Harmony LLC constitute medical advice. They are also not a substitute for an examination or treatment by a doctor or therapist.

Code & Harmony LLC is entitled to change the functionality and design of Touch for Health to go at any time.

Should individual clauses of these Terms of Use be or become invalid, this shall not affect the validity of the remaining provisions.

2 Provision of the App

Use requires the download and successful installation of the app from the Apple App Store or Google Play Store. The terms of the respective store apply to the download of Touch for Health to go.

All natural persons are entitled to use Touch for Health to go.

3 Premium Subscription

Touch for Health to go can be used free of charge in a limited scope. The free version includes all 14 muscle tests and all techniques of the stomach meridian. A premium subscription (monthly or yearly) unlocks all techniques.

The subscription is purchased in the Apple App Store or Google Play Store. The current price is shown in the store before you buy and may vary by country. Payment is charged to your Apple Account or Google account when the purchase is confirmed.

The subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. You can manage and cancel your subscription at any time in the account settings of the respective store. Deleting the app does not cancel the subscription.

Billing, refunds and cancellation are handled by Apple or Google in accordance with the terms of the respective store. Statutory rights, in particular mandatory consumer rights such as a right of withdrawal where applicable, remain unaffected.

4 Rights to Use Information, Software and Documentation

The use of the provided information, software and documentation is subject to these terms. Separately agreed license terms, e.g. when downloading software, take precedence over these terms.

Neither information, software nor documentation may be distributed, rented or otherwise made available to third parties by the user at any time. The information, software and documentation are protected by copyright laws and other intellectual property laws and agreements. The user is obliged to respect these rights.

5 Intellectual Property

Information, brand names, design and other content of Touch for Health to go may not be changed, copied, reproduced, sold, rented, traded, used, supplemented or otherwise exploited in any way without the prior written consent of Code & Harmony LLC.

Apart from the rights of use or other rights expressly granted herein, the user is not granted any further rights of any kind, in particular to the company name and industrial property rights such as patents, utility models or trademarks, nor is Code & Harmony LLC obliged to grant such rights.

Insofar as the user submits ideas and suggestions within the app, Code & Harmony LLC may use these free of charge for the development, improvement and sale of products from its portfolio.

6 User Obligations

The user uses Touch for Health to go as part of their kinesiology training or work.

Using the app does not replace:

learning the technique as part of a course or training
acquiring well-founded information from literature, e.g. Touch for Health Complete Edition 2005, John and Matthew Thie
consulting a doctor for health problems

7 Hyperlinks

The Touch for Health to go app may contain hyperlinks to third-party websites. Code & Harmony LLC assumes no liability for the content of these websites, since it is not responsible for the content and information provided there. Their use is at the user’s own risk.

8 Use of Touch for Health to go

In Touch for Health to go you will find various information on health, exercise and similar topics for informational purposes. It does not replace personal advice, care or treatment by professionals. Touch for Health to go does not indicate to the user when a doctor’s visit would be necessary.

Code & Harmony LLC can change or discontinue Touch for Health to go at any time without prior notice. It can also change these terms at any time. Changes will be displayed in an appropriate manner and the consent of users will be obtained.

These Terms of Use are governed by the laws of the State of Wyoming, USA, excluding its conflict of law provisions. To the extent permitted by law, the courts of Wyoming have jurisdiction. Mandatory consumer protection provisions of the country in which the user habitually resides, including mandatory places of jurisdiction, remain unaffected.
